PayPal limited your account? Read the clock before you panic.
A limitation, a hold and a closure are three different things in PayPal’s user agreement, and each one has its own rules about your money. This page lists what PayPal’s own agreements and help pages say, with the source next to each point. It is general information, not legal advice.
Everyone: lift the limitation from inside your account
- Find the request. Log in and open the Resolution Center, or click the bell icon at the top of your account, to see what PayPal is asking for (PayPal Help).
- Phone calls won’t lift it. PayPal says “in most cases, our customer service team can’t remove your limitation over the phone” (PayPal Help). Once you complete the steps, the review “usually takes 3 business days” and PayPal emails you the result (PayPal Help).
- Beware fake emails. PayPal’s help page asks you to forward suspicious “limitation” emails to phishing@paypal.com. Log in by typing paypal.com yourself, never from a link.
- You can’t simply close the account to get out. The US user agreement says you may not close an account to evade an investigation, or while it has a pending transaction, an open dispute or claim, a negative balance, or a hold, limitation or reserve (US User Agreement).
- Save every notice, document request and reply in the evidence log, and put the 21-day and 180-day dates below into the deadline calculator.
How long PayPal says it can hold money
| Situation | What the agreement says |
|---|---|
| Risk-based hold on a payment you received | “generally remain in place for up to 21 days from the date the payment was received”; PayPal may release it earlier |
| The payment is disputed | Held “until the matter is resolved (but no longer than 180 days)” |
| Restricted activities or Acceptable Use Policy breach | Balance may be held “for up to 180 days if reasonably needed to protect against the risk of liability or if you have violated our Acceptable Use Policy”, longer than 180 days where a court order, law, regulation or other legal process requires it |
| PayPal closes the account | PayPal gives notice and makes “unrestricted funds” available for you to withdraw |
| Reserve | A rolling or minimum reserve may be set on a business account (the agreement’s example is 10% held for a 90-day rolling period) |
“Unrestricted” matters: money under a hold, limitation or reserve can stay put after a closure until that hold ends. Unless a limitation is permanent, the agreement says it is resolved by giving PayPal the information it asks for.
EU: PayPal Europe is a Luxembourg bank
If you are in the EU you contract with PayPal (Europe) S.à r.l. et Cie, S.C.A., a bank licensed in Luxembourg and supervised by the CSSF. Its user agreement (“Last updated on 22 January 2026”) says (EU User Agreement, Ireland version):
- PayPal may close your account “at our convenience by providing you with two months’ prior notice”, or sooner for listed reasons.
- Funds may be held “for so long as reasonably needed to protect against the risk of liability”, which can be more than 180 days for restricted activities.
- Complaints about payment services get a reply within 15 business days, extendable to 35 business days for reasons beyond PayPal’s control. If you are unhappy with the answer, the agreement lists the CSSF, the European Consumer Centres Network (ECC-Net) and FIN-NET as out-of-court routes.
The EU’s P2B Regulation says it “should also not apply to online payment services” (recital 11; Art. 1(3)), so the 30-day notice rule that protects marketplace sellers does not help here. A GDPR access request still works: ask PayPal for your data and whether the limitation was an automated decision.
UK: complain, then go to the Financial Ombudsman
UK accounts are with PayPal UK Ltd, authorised by the FCA (firm reference number 994790). Its user agreement (“Last updated on 12 October 2026”) says a final response can take up to 15 business days for payment complaints and up to 8 weeks for others. You can then go to the Financial Ombudsman Service within 6 months of PayPal’s response, if you meet its eligibility criteria; the FOS is free (UK User Agreement). A UK GDPR access request runs alongside it.
United States: arbitration, with a small-claims door
The US user agreement sends most disputes to individual arbitration (administered by JAMS) but keeps small claims open:
“… shall be resolved through final and binding arbitration, except that you or we may elect to have a Dispute heard in small claims court, so long as it proceeds individually and is not removed or appealed to a court of general jurisdiction.”
- Notice first. Before arbitration or small claims, you must try to resolve it informally: send PayPal’s Notice of Dispute form by certified mail to PayPal, Inc., Attn: Legal Specialists, Re: Notice of Dispute, P.O. Box 45950, Omaha, NE 68145-0950. The agreement then allows 60 days of informal negotiation.
- Opt-out. You could opt out of arbitration with a written notice postmarked no later than 30 days after you first accepted the agreement, mailed to PayPal’s San Jose address. For most long-time users that window has passed.
- Disputes that are not arbitrated go to the state and federal courts in New York County, New York, except small-claims cases.
- California residents can also file a complaint with the Department of Financial Protection and Innovation, which the agreement names.
The state-by-state small-claims table has each state’s limit and filing fee, and the letter kit drafts a dated demand letter you can adapt.
